Terms of Service

These Terms of Service ("Terms") govern your access to and use of the wair.llc website ("the Site") and the Wair mobile application ("the App") operated by Aquila Labs LLC ("Wair", "we", "us", "our"), a company registered in Sheridan, WY 82801, USA.

By accessing the Site or installing/using the App, you agree to be bound by these Terms. If you do not agree, do not use the Site or the App.

1. Eligibility

You must be at least 16 years old to use Wair. If you are between 16 and 18 (or the age of majority in your jurisdiction), you confirm that you have your parent's or guardian's permission.

2. Your account

Some features (especially in the App) require you to create an account.

• You agree to provide accurate, current information and to keep it updated.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must notify us promptly at support@wair.llc if you suspect unauthorized use of your account.
• We may suspend or terminate your account for violations of these Terms, illegal activity, or risk to other users.

3. License to use

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Site and the App for personal, non-commercial purposes.

4. Acceptable use

You agree NOT to:

• Use the service for any unlawful purpose
• Upload content that infringes third-party intellectual property, depicts illegal acts, or violates someone's privacy
• Reverse engineer, decompile, or attempt to extract our underlying models or technology
• Use automated scrapers, bots, or scripts to access the service
• Resell, sublicense, or commercialize any part of the service without our written permission
• Bypass any security or rate-limiting measures

5. User content

You retain ownership of content you upload (e.g., wardrobe photographs, photos you upload of yourself, notes). By uploading content to Wair, you grant us a worldwide, royalty-free license to host, process, and display that content solely for the purpose of providing the service to you (including processing to generate styling recommendations and try-on images). We use it for no other purpose.

We do not claim ownership of your content and we do not use your photographs to train models for any other user without your explicit consent.

6. Style recommendations

Wair analyzes your wardrobe to suggest outfits, colors, and styling combinations. These recommendations are opinions, not advice. Style choices are personal; we do not guarantee any specific outcome (compliments, fashion success, weather suitability, etc.). Use your own judgment.

Try-on images are visualizations generated for you; they are illustrative and may differ from how garments fit in real life.

7. Subscriptions

Wair offers an optional Wair Premium subscription with monthly and annual auto-renewing plans. The annual plan includes a 7-day free trial.

• Pricing: Current prices are shown in the app on the purchase screen before you buy. Prices may vary by region and are subject to change with reasonable advance notice.
• Auto-renewal: Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal through your Apple App Store or Google Play account.
• Free trial: Any unused portion of a free trial is forfeited when you purchase a subscription.
• Cancellation: You can manage or cancel your subscription at any time in your device's subscription settings (App Store or Google Play). Deleting the app or deleting your Wair account does not cancel your subscription.
• Refunds: Refunds are handled by the store where you made the purchase (Apple or Google) and are subject to that store's refund policy.

8. Intellectual property

The Wair name, logo (the ametrine "W" mark and lockup), website design, App interface, and the underlying models and technology are owned by Aquila Labs LLC and protected by copyright, trademark, and other laws. You may not copy or use them without our written permission.

9. Termination

You may stop using Wair and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if continued provision becomes impractical. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

10. Disclaimers

THE SITE AND THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT THE STYLE RECOMMENDATIONS WILL BE ACCURATE; OR THAT THE SITE OR APP WILL MEET YOUR EXPECTATIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUILA LABS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted.

12. Indemnification

You agree to defend and indemnify Aquila Labs LLC against claims arising from your misuse of the service, your content, or your violation of these Terms or applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Wyoming, unless your local consumer protection law gives you additional rights that cannot be waived.

14. Changes to these Terms

We may revise these Terms from time to time. The "Effective date" at the top reflects the most recent revision. If changes are material, we will notify you via the Site or the App before they take effect. Continued use after a change means you accept the revised Terms.
